HIGH COURT OF JUDICATURE AT ALLAHABAD ?Court No. - 34 Case :- WRIT - A No. - 28619 of 2014 Petitioner :- Union Of India Thru' Sr. Superintendent Of Post Offices Respondent :- Shyam Sundar Dwivedi And Another Counsel for Petitioner :- Saurabh Srivastava Counsel for Respondent :- S.C. Hon'ble Sudhir Agarwal,J.
Hon'ble Bachchoo Lal,J.
1. Case called out. None appeared on behalf of petitioner. However, we ourselves have perused the record.
2. By means of the present writ petition, petitioner has sought the following reliefs :
i) Issue a writ of certiorari by way of quashing the orders dated 5.2.2013 and 12.8.2013 (annexure no. 1) passed by learned Central Administrative Tribunal, Allahabad in Original Application No. 1087 of 2009, Shyam Sundar Dwivedi Vs.Union of India and others, and Civil Misc. Review Application No. 30 of 2013, Union of India and others Vs. Shyam Sundar Dwivedi respectively.
ii) Issue a writ of mandamus calling for entire records pertaining to the instant case. "
3. However, we ourselves have gone through the pleadings, grounds as also reliefs sought and find that petitioner is not able to make out a case so as to justify interference of this court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or that petitioner has lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for the petitioner is absent.
5. Dismissed. Interim order, if any, stands vacated.
