Counter affidavit filed on behalf of State be taken on record.
Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
It has been contended by learned counsel for the applicant that the mother of the applicant, aged about 70 years, is ill. She is suffering from Cancer disease on her neck and the doctor has suggested for operation of cancer. There is no other male person in applicant's family to look-after his mother and his younger brother is missing since five years. It has further been submitted that the applicant is in jail since 13.4.2016.
Per contra Learned A.G.A. opposed the prayer for bail and argued that the treatment of mother of applicant is going on in Rama Hospital Lakhanpur district Kanpur Nagar. The first bail application of the applicant has been rejected on merit by this court vide order dated 19.10.2016.
Considering the facts and circumstances of the case and the submissions advanced by learned counsel for the parties, I do not find any good ground to release the applicant on parole/ short term bail. Accordingly, the parole / short term bail application is hereby rejected.
