We have heard Shri G.K. Gupta, learned counsel for the petitioner, Shri S.K. Srivastava, learned counsel for the Bank.

Learned counsel for the respondent has pointed out that this is a third writ petition( earlier two writ petitions being writ petition nos. 18562 of 2016 and 33759 of 2016) of the petitioner for the same cause of action.

In view of above, we are not inclined to interfere in the proceedings under the SARFAESI Act. It is open to the petitioner to take recourse to the statutory remedy available to him under the law.

It is accordingly dismissed.
