Heard learned counsel for the applicants who submits that applicants no. 1 is father of opposite party no.2 who on the pressure of her in-laws, has lodged a First Information Report with false and fictitious allegations. Matter may be settled amicably if recourse to mediation is taken.

Considering the facts and circumstances of the case and submissions of the learned counsel for the applicants, let the matter be referred to Mediation Centre.

It is directed that applicants shall deposit a sum of Rs. 10,000/- within one week from today with the Mediation Centre of which 75% shall be paid to the opposite party no.2 for appearance before the Mediation Centre.

Issue notice to opposite party no.2 returnable at an early date.

It is clarified that in case the applicants deposit Rs.10,000/- as indicated above, in the account of Mediation and Conciliation Centre, High Court, Lucknow, within a period of one week from today. Out of the aforesaid amount, a draft of Rs.7,500/- in the name of opposite party no.2 shall be handed over to her on her first appearance. The applicants and opposite party no. 2 shall appear before the Mediation Centre on 06.12.2017.

List on 08.03.2018 before the regular Bench with report of the Mediation Centre, if any.

Till the next date of listing, no coercive action shall be taken against the applicants in Complaint Case No. 90 of 2017 under sections 323, 504, 506, 354 I.P.C., P.S. Saadatganj, Lucknow pending before Third Additional Chief Judicial Magistrate, Lucknow.  

In case, the aforesaid amount is not deposited, the interim order shall automatically stand vacated without any reference to this Court.
