Heard learned counsel for applicant who submits that a First Information Report was lodged with the allegation that applicant got executed two sale deeds in the year 1991 and 1992 in favour of his servants Suresh Kumar and Sohan Lal and in the garb of that sale deeds he has occupied the said land. Learned counsel submits that applicant has nothing to do with Suresh Kumar and Sohan Lal. The dispute is absolutely absurd and the revenue papers have been corrected accordingly. The prosecution is malafide because opposite party no.2 wanted to purchase the land of applicant and he declined.

Let counter affidavit be filed within three weeks. Rejoinder affidavit may be filed within one week thereafter.

Till the next date of listing, no coercive action shall be taken against the applicant in Criminal Case No. 1666 of 2011 arising out of Case Crime No. 31 of 2011 under Sections 419, 420, 467, 468, 471, 506 I.P.C., P.S. Kotwali Nagar, District Barabanki pending in the court of Chief Judicial Magistrate, Court No. 18, Barabanki.
