Hon'ble Dr. Kaushal Jayendra Thaker,J.

1.  Accused and his Advocate remained absent and non bailable warrant was issued on him. However, Police Officer for 20 days has not arrested the accused. 

2.  Today he has filed recall application. It appears that Police must have conveyed about issuance of non bailable warrant.

3.  The Officer concerned to explain why the accused was not arrested till date pursuant to Court's order dated 2nd May, 2017.

4.  Be that as it may, it is stated by Sri Anil Kumar Tiwari, learned counsel for appellant that he has not been arrested. He further states that he has been duly engaged  and he has filed recall application. As the accused is still not arrested and there is no reply from Police why he has not yet been arrested. The order issuing non bailable warrant is recalled and he shall personally remain present on 7th July, 2017 and on that date the matter be heard.

5.  Office is directed to supply paper book to Sri Anil Kumar Tiwari and list this matter on 7th July, 2017.

6.  When the case is  listed next, name of Sri Pradeep Srivastava- Advocate be not shown in the cause title/cause list.
