Heard Sri S.C. Srivastava, learned counsel for the petitioner and learned Standing Counsel for the State respondents.
Learned counsel for the petitioner submitted that this case is squarely covered by judgments passed by this Court in the cases of Writ - A No. - 61974 of 2011 (Dr. Amrendra Narain Srivastava Vs. The State of U.P. and others), Writ - A No. - 27579 of 2014 (Dr. Prem Chandra Pathak and another Vs. State of U.P. and others) and Writ - A No. - 64053 of 2015 (Hrishi Kesh Pandey Vs. State of U.P. and others).
Perusal of record reveals that services of the petitioner are not regularized and he is claiming for benefit of pension on the basis of ad hoc services rendered by him, while services of the petitioners relating to aforesaid cases of Dr. Amrendra Narain Srivastava, Dr. Prem Chandra Pathak and Hrishi Kesh Pandey were regularized. Hence, this case requires consideration.
Learned Standing Counsel prays for and is granted three weeks' time to file counter affidavit. Petitioner will have one week thereafter to file rejoinder affidavit.
