This appeal is posted under the heading of Order 41 Rule 11 C.P.C.

It is submitted by the learned counsel that connected second appeal No. 1159 of 1996 has already been admitted arising out of the same impugned judgement/decree, has already been posted for final hearing. The same appeal  has been shown in the cause list as decided on 12.8.2014 whereas the appeal has already been restored by this Court vide order dated 30.9.2015.

In view of the admission of the connected appeal, present appeal No. 87 of 1997 is also admitted.

Learned counsel for respondent nos. 2 and 3 Sri K.S. Amist is present whereas the name of the learned counsel for respondent nos. 4,5,6 and 7 is also shown in the cause list.

The learned counsel for the appellant is directed to furnish a copy of the memo of appal along-with the relevant papers to respondent nos. 2 to 7.

Issue notice to respondent no.1 returnable at an early date. Steps be taken within a week.
