The present writ petition, petitioner has challenged the order dated 07.12.2016. Petitioner claims that after due advertisement, he was selected by Committee of Management for a Class IV post. However, by impugned order, the District Basic Education Officer has refused to grant approval to the said appointment. In the impugned order, District Basic Education Officer amongst other grounds noted that Class IV vacancies now be filled by outsourcing.

Sri J.P.S. Rathaur, appearing for opposite party no.3 states that such a direction is given by Government Order dated 06.01.2011.

Notices on behalf of opposite parties no. 1 and 2 are accepted by learned Chief Standing Counsel.

Issue notice to opposite party no.4.

Opposite party nos. 1, 2 and 3 are granted four weeks' time to file reply as to how Class IV posts in a recognized institution can be required to be filled by outsourcing. Rejoinder affidavit may be filed within one week thereafter.

List after the aforesaid period.
