Heard Sri Abrar Ahmad, learned counsel for the petitioner, learned Standing Counsel for the State-respondent and Smt. Archana Singh learned counsel appearing for respondent No.2.
Learned counsel for the petitioner states that the facts of this case are identical to the facts involved in Writ-A No.16566 of 2017 (Mohd. Shakeel Khan vs. State of U.P. and Anr) which petition has been entertained and counter affidavit has been called for. This fact has not been disputed by Ms. Archana Singh, learned counsel for the respondent no.2.
Issue Notice.
Notice on behalf of respondent no. 1 has been accepted by the office of learned Chief Standing Counsel, whereas notice on behalf of the respondent no.2 has been accepted by Smt. Archana Singh. Therefore, notices need not be served again to the aforesaid respondents.
Learned standing counsel as well as learned counsel for the respondent no.2 pray for and are granted six weeks time to file counter affidavit.
Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List thereafter along with the records of Writ-A No.16566 of 2017 (Mohd. Shakeel Khan vs. State of U.P. and Anr).
