Heard learned counsel for the applicant, learned  A.G.A. for the State and perused the record.

Learned counsel for the applicant submits that the applicant had been appointed on the post of lecturer (Hindi) in Sadanand Post Graduate College, Chhiulha, District Fatehpur w.e.f. 2.8.1976. The appointment of the applicant was against the wishes of opp. party no. 2. In one or other pretext, the Committee of Management was bent upon to terminate the services of the applicant and subsequently, the applicant was terminated from his services only due to applicant was witness in the embezzlement case initiated by the State Government against the Committee of Management. The Members as well as Manager of the  Committee of Management were in jail for several months in the said embezzlement case. It has further been submitted that the applicant had been retired from his services on 30.6.2009. The present prosecution has been instituted only for the purpose of harassment. The applicant has not committed the alleged offence. No offence is made out against the applicant.

Learned  A.G.A. accepted notice on behalf of State.

Issue notice to the opp. party no. 2 who may file counter affidavit till the next date of listing.

List on 16.8.2017.

Till the next date of listing no coercive action shall be taken against the applicant in complaint case no. 4161 of 2012, Raja Ram Tripathi Vs. Dr. Vidyadhar Dwivedi, u/s 323, 504 and 506 I.P.C. Police Station Khaga District Fatehpur.
