1. This is third bail application moved on behalf of applicant-accused i.e Sunil Chaurasia for his release on the ground that Trial has not concluded within time frame given by this Court vide order dated 22.12.2016.

2. From record it is born out that first bail application was rejected by this Court after passing a detailed order on 29.07.2013 thereafter, Second bail application was also disposed of with the direction to the Court concerned to decide session trial within two months. It has been pointed out by learned counsel for applicant-accused that all the witness have been examined and statement of applicant-accused under Section 313 Cr.P.Chas also been recorded but by the order passed by this Court on application of complainant under Section 407 Cr.PC, the proceeding of the trial was stayed.

3. It appears that session trial was transfered from one Court to another Court from which the complainant was aggrieved and he preferred an application under Section 407 Cr.PC bearing no. 20 of 2017. This Court vide order dated 10.03.2017 stayed the order of the Session Judge, Sultanpur transferring the case. Learned counsel for the applicant-accused has put in apperance in that case thus only argument of party concerned session trial is remained.

5. In these circumstances, this bail application does not deserve to be allowed only on the ground that Trial has not concluded within time frame fixed by this Court.

6. In view of above facts, this bail application is rejected.
