A compromise dated 9.12.2017 has been filed by the appellant through its counsel Sri Jag Ram Singh,  respondent no. 1 Nem Chandra in person and respondent no. 2 Smt. Aaga @ Suneeta through her counsel Sri Surya Shankar Pandey in which they have agreed to enter into a compromise on the following terms and conditions:-

(i) The respondent nos.1 and 2 shall be entitled to get Rs. 1,50,000/- (One lacs fifty thousand) and four point five percent interest thereon in full and final satisfaction of his claim from appellant U.P.S.R.T.C.

(ii) The amount already deposited/ received shall be adjusted towards the total amount due.

(iii) The amount due as above shall be deposited/paid through cheque within 90 days from the date of receipt of copy of the order of this Court failing which interest @ 6 % per annum shall accrue from such date till payment.

(iv) Cross appeal, if any, shall stands withdrawn.

(v) In addition to this, respondent no. 2 Smt. Aaga @ Suneeta has also executed an authority letter dated 27.11.2017 in favour of her husband respondent no. 1 Nem Chandra that he may appoint a counsel in this case on her behalf and may enter into a compromise also.

The appeal is accordingly decided in terms of compromise dated 9.12.2017. Compromise filed today shall form the part of judgment and award. Award be drawn accordingly.

A copy of this order be sent to the court concerned for necessary compliance.
