Heard Sri Anil Tiwari, learned Senior Advocate assisted by Sri Approva Tewari, learned counsel for petitioners on the application for amendment.
By means of the present application, petitioners wants to challenge the final seniority list of the cadre of Review Officers in the Secretariat Administration Department issued on 05.08.2016.
Opposite parties were granted time to file objections, if any, by order dated 7.11.2017. By subsequent order dated 21.11.2017 one week's further time to seek instructions or to file objection against the proposed amendment to the learned Standing Counsel.
No objection has been filed on behalf of opposite parties. Learned Standing Counsel orally says that he has no objection to the proposed amendment.
On consideration of the above, the application is allowed. Learned counsel for petitioners is permitted to amend in the memo of petition within a week and to file the amended writ petition.
Learned Standing Counsel may file counter affidavit to the amended writ petition within four weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.
List after the expiry of the aforesaid period.
