The prayer is for expeditious disposal of Divorce Petition No.707 of 2015 (Vibhor Bhatiya Vs. Smt. Priyanka Narang). A perusal of the order sheet indicates that the suit had proceeded ex-parte in the year 2016. After the recall of the order to proceed ex-parte, the respondent has filed an application under Section 24 of the Hindu Marriage Act' 1955 seeking maintenance pendente-lite. It has not been disclosed by the petitioner as to whether any objection has been taken by him to the said application.
In view of the pendency of Section 24 application, no direction for disposal of the divorce petition within a stipulated time can be issued.
However, it is expected that the Court below shall make an endeavour to decide the dispute between the parties, expeditiously. The Court below shall also explore the possibility of amicable settlement through mediation between the parties. In view of the observation of the Apex Court in the case of Krishna Veni Nagam Vs. Harish Nagam passed in Transfer Petition (Civil) No.1912 of 2014.
The present petition is disposed of.
