Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.

Learned counsel for the applicants submits that the present complaint has been filed after more than one year from the date of alleged incident which is barred by Section 468 Cr.P.C and the present complaint is not maintainable.

Learned  A.G.A. has accepted notice on behalf of State.

Issue notice to the opp. party no. 2 who may file counter affidavit within a period of three weeks. Rejoinder affidavit may be filed within a week thereafter.

List on 13.10.2017.

Till the next date of listing,  further proceeding of the case no. 3099 of 2014, Smt. Ranjana Yadav Vs. Santosh Kumar and others, under sections 18, 19, 20, 21 and 22 of the Protection of Women From Domestic Violence Act, 2005,  pending in the court of A.C.J.M. II, Allahabad,  shall remain stayed.
