Heard learned counsel for the applicant, learned  A.G.A. for the State and perused the record.

Learned counsel for the applicant submits that the applicant has paid entire amount of the alleged cheque to the opp. party no. 2 and in this regard a deed was also executed in between the applicant and the opp. party no. 2 on 27.6.2017 and the matter has been settled in between the parties. The opp. party does not want to proceed with the matter further.

Learned  A.G.A. has accepted notice on behalf of State.

Issue notice to the opp. party no. 2 who may file counter affidavit within a period of three weeks. Rejoinder affidavit may be filed within a week thereafter.

List thereafter.

Till the next date of listing no coercive action shall be taken against the applicants in complaint case no.  5066 of 2012, Ajay Kumar Singh  Vs.  Kunwar Prasad,  and other 138 N.I. Act. pending in the court of A.C.J.M. VI,  Varanasi.
