We have heard Sri Man Mohan Singh, learned counsel for the petitioners, learned Standing Counsel for respondent Nos. 1 and 2 and Smt. Archana Singh learned counsel for respondent No. 3.

At the very outset, learned counsel for the petitioners pointed out that the facts of this case are similar to the facts involved in Writ Petition No. 23433 of 2017 (Dr. Shailendra Singh and Others Vs. State Of U.P. and 2 Others) which is pending and counter affidavit has been called for.

The factum of the submissions made by learned counsel for the petitioners has not been disputed by learned counsel for the respondents.

Issue notice.

Notices on behalf respondent Nos. 1 and 2 have been accepted by the office of learned Chief Standing Counsel and Smt. Archana Singh has put in appearance for respondent No. 3, therefore, notices need not to be served to the aforesaid respondents.

Learned counsel for the respondents may file counter affidavit within three weeks. Rejoinder affidavit, if any, may be filed within two weeks thereafter.

List thereafter alongwith the record of Writ Petition No. 23433 of 2017, Dr. Shailendra Singh and Others Vs. State Of U.P. and 2 Others.
