1. Report has been received regarding release of appellants-accused Ram Avtar and Ram Swarop.

2. Appellants-accused Shiv Kumar, Naresh and Shiya Ram have remained absent despite issue of Non Bailable Warrant against them. It transpires from the record that appellant-accused Shiya Ram was arrested and released on bail thereafter he again remained absent, therefore, Non Bailable Warrant were issued against accused persons.

3. Chief Judicial Magistrate, Sitapur was directed to ensure presence of appellant-accused Shiv Kumar, Naresh and Shiya Ram but the Chief Judicial Magistrate, Sitapur has sent report only regarding completion of sentence and released of accused Ram Awatar and Ram Swarop. Nothing has been mentioned in this report about appellant-accused Shiv Kumar, Naresh and Shiya Ram.

4. Hence. Chief Judicial Magistrate, Sitapur shall ensure presence of appellant-accused Shiv Kumar, Naresh and Shiya Ram.
