Heard learned counsel for the applicants, learned  A.G.A. for the State and perused the record.

Learned counsel for the applicants submits that the applicant no. 1 is father-in-law and the applicant no. 2 is brother-in-law of the opp. party no. 2. The marriage of daughter of applicant no. 1 namely Kalpana was solemnized with the opp. party no. 2 on 19.4.2016. The applicant no. 1 had lodged a first information report against the opp. party no. 2 and his family members under section 498-A, 504, 506 I.P.C. and 3/4 D.P. Act on 5.11.2016. In counterblast, the opp. party no. 2 has filed this false and frivolous complaint against the applicants. In fact no offence is made out against the applicants. False story has been concocted by the opp. party no. 2. The summoning order dated 5.6.2017 is not in accordance with law. The present prosecution has been instituted only for the purpose for harassment.

Learned  A.G.A. has accepted notice on behalf of State.

Issue notice to the opp. party no. 2 who may file counter affidavit within a period of three weeks. Rejoinder affidavit  may be filed within a week thereafter.

List thereafter.

Till the next date of listing, no coercive action shall be taken against the applicants in complaint case no.10045 of 2016, Sundar Singh  Vs. Anantram and others, under Section  323, 504, 452  I.P.C.  Police Station Pilakhuwa, District Hapur.
