Heard learned counsel for the applicants, learned A.G.A. for the State and perused the record.
Learned counsel for the applicants submits that the applicant no. 1 is daughter-in-law of the opp. party no. 2. The applicant no. 1 has lodged a first information report against the opp.party no. 2 and five other under sections 376, 511, 498-A, 323, 452, 406, 504, 506 I.P.C. and 3/4 D.P. Act. In that case, the Investigating Officer submitted final report against which the applicant no. 1 has moved a protest petition which is still pending. Only to make pressure upon the applicants, the opp. party no. 2 has filed this false and frivolous complaint. The applicants have not committed the alleged offence.
Learned A.G.A. has accepted notice on behalf of State.
Issue notice to the opp. party no.2 who may counter affidavit within a period of three weeks. Rejoinder affidavit may be filed within a week thereafter.
List thereafter.
Till the next date of listing, no coercive action shall be taken against the applicants in complaint case no. 480 of 2016 under sections 323, 504, 506 I.PC. police Station Naubasta District Kanpur Nagar.
