Heard learned counsel for the petitioner and the learned standing counsel for the respondents.
The petitioner is aggrieved on account of non-consideration of freehold rights for which it is alleged that the petitioner has already made requisite deposit in terms of the Government orders that were existing as on 10.09.2012. The submission is that if the petitioner has already complied with the terms and conditions thereof, there should be no delay but the respondents having failed to grant the freehold rights, a mandamus be issued to that effect.
Learned standing counsel submits that freehold rights have to be determined in accordance with the relevant Government orders and the respondent No.2 and 3 who are the authorities competent to deal with the matter shall examine the claim of the petitioner and pass appropriate orders.
We accordingly direct the respondent No.3 to look into the claim of the petitioner and pass appropriate orders in the light of any Government order that may be applicable to the controversy expeditiously preferably within three months from the date of presentation of a certified copy of this order before him.
The petition is disposed off with the said observations.
