As per direction of this Court Mr.Sunil Kumar Singh, learned counsel for the respondents 3 and 4 has received instructions and on the basis of instructions he has submitted that during the course of inspection of the School on May 13 2016 certain administrative lapses were found on the part of the Teachers, therefore, the petitioner has been transferred to different place.
The learned counsel for the petitioner Mr.Shahi has submitted that on that date three theachers were absent, but no action has been taken against them.
In view of the aforesaid submission, since I am not inclined the interfere with the action taken against the petitioner, I hereby observe that the necessary action may also be taken against the teachers who were found unauthorizedly absent on the date of inspection. In so far as the punishment awarded to the teachers vide order dated 20 May 2016 is concerned, I have been informed that the matter is under consideration of District Basic Education Officer, Kanpur Nagar. Therefore, at this stage no purpose would be served to keep the matter pending. Let the matter of disciplinary action be finalized by the District Basic Education Officer concerned expeditiously after providing opportunity of hearing the parties concerned.
With the aforesaid direction the writ petition stands disposed of finally.
