It is contended on behalf of the learned counsel for the petitioner that the respondents have advertised total 148 posts, out of which, 74 posts were unreserved, 40 posts under OBC category, 31 posts under Scheduled Caste category and 03 posts under Scheduled Tribes category. However, the result has been declared only for 146 posts. It is submitted that without disclosing the reasons, the respondents have not declared the result of one post of OBC and one post of Scheduled Caste.
Lastly, it is urged that the horizontal reservations were to be made compartmental-wise and not over all reservation. He has placed reliance on judgments of Supreme Court in the cases of Anil Kumar Gupta V. State of U.P. and others, (1995) 5 SCC 173 (Pr. 17 and 18). and Rajesh Kumar Daria V. Rajasthan Public Service Commission, (2007) 8 SCC 785.
Matter needs consideration.
Learned Standing Counsel may file counter affidavit within two months. Rejoinder affidavit, if any, may be filed within a week thereafter.
Learned Standing Counsel will produce the merit list of the General Candidate, OBC Candidate, SC Candidate separately and the combined merit list on the next date fixed.
List in the week commencing 08.08.2016.
Till the next date of listing, one post shall be kept reserved under OBC category.
