Heard learned counsel for the applicant and learned A.G.A. for State.
It is contended by learned counsel for the applicant that the F.I.R was lodged by the father of the victims namely Km. Sanjana aged about 13 years and Km. Deepali aged about 15 years that on 27.05.2015 at about 11:00 a.m. when his daughters were coming from Sulabh Sauchalaya then accused - applicant alongwith co-accused Sunny abducted both the girls. It is contended by learned counsel for the applicant that no marks of injury was found on the part of the victims and therefore they were consented parties.
From the medical report the age of Km. Sanjana is sated to be 16 years. In her statement recorded under Section 164 Cr.P.C. Km. Sanjana clearly stated her age is to be 13 years and has impleaded the accused for abduction. Whereas Km. Deepali also supported the case of prosecution and also said that they were threatened for dire consequences and she was raped by Sunny.
Seeing the facts of the circumstances of the case and age as well as statements recorded under Section 164 of Cr.P.C, I find that there is no good ground to release the applicant is made out.
The bail application is rejected.
