Learned Standing Counsel has accepted notice on behalf of respondent nos. 1 to 4, Sri Hem Pratap Singh has accepted notice on behalf of respondent no.6 and Sri Harsh Vardhan Choubey has put in appearance on behalf of respondent no.5.

As prayed by them, two months time is granted to file counter affidavit. Rejoinder affidavit, if any, may be filed within a week thereafter.

List after expiry of the aforesaid period.

Learned counsel for the petitioner has drawn the attention of the Court that in the case of similarly placed person, this Court has granted an interim order in writ petition no. 14148 of 2016 (Sushil Kumar Rao V. State of U.P. and others) on the ground that a batch of writ petitions raising the same issue, has been finally allowed by this Court in Writ-A No.3636 of 2005 (Jagdish Narayan Doharey V. State of U.P. and others).

In view of the above, till the next date of listing, the petitioner shall be allowed to function as Senior Auditor, Grade-II, District Audit Office, Sonbhadra.
