The petitioner retired on 31.07.2008 from the post of Lekhpal. He has preferred this writ petition for a direction upon the respondents for payment of post retiral benefits.
It is contended on behalf of the petitioner that the State Government has framed U.P. Pension Cases (Submission, Disposal and Avoidance of Delay) Rules, 1995. The said rules have been framed by the State Government in exercise of the power conferred by the proviso to Article 309 of the Constitution. In the said rules, time schedule has been provided to avoid the delay in payment of the post retiral benefits to the employee.
The grievance of the petitioner is that his pension has been paid after a lapse of 3 to 6 years. However, no interest has been paid in terms of the aforesaid rules and the law laid-down by the Supreme Court.
Learned Standing Counsel may seek instruction in the matter.
List this case on 23.05.2016 among top ten cases with liberty to the learned counsel for the petitioner to make a mention to take up the case out of turn.
