It is submitted by learned counsel for the applicant that accused ? Pitambar, who was granted bail by the Court of Sessions Judge, Saharanpur, vide order dated 08.04.2016 in Bail Application No. 710 of 2016, has misused his bail conditions as such his bail is liable to be cancelled.

It is further submitted that opposite party no. 2 - Pitambar threatened the applicant and a complaint was also made to the S.S.P. Saharanpur, through registered post dated 25.4.2016, copy of which is annexed as annexure -04 and opposite party no. 2 has also threatened to the eye-witnesses of the matter namely Arvind Thakur and thereafter Arvind Thakur also filed a complaint before the S.S.P. Saharanpur through registered post on 02.05.2016.

From the complaints made by the applicant as well as eye-witness of the case time and place of the threatening has also been disclosed in a clear manner. In case crime no. 28 of 2016 there were seven accused and it is submitted by the learned counsel that except for opposite party no. 2 none of accused person has surrendered so far. They have also threatened alongwith opposite party no. 2. Thus the case of the applicant is on sound footing and the matter requires to be heard in presence of opposite party no. 2.

Notice be issued to file counter affidavit in four weeks from today.
