The petitioner claims to have retired from the post of Assistant Teacher in Thakur Malkhan Singh Inter College, Hasauna Jagmohanpur, Aligarh on 31.3.2016. The grievance of the petitioner is that his retiral dues have not been finalized and paid as yet and in this regard, he has moved a representation on 28.6.2016 before the third respondent, which has not yet been decided.

Considering the nature of the prayer made, learned Standing Counsel who represent the respondents 1 to 3 submits that this petition may be disposed of requiring the third respondent to consider the claim of the petitioner in accordance with law.

In view of above, the writ petition is disposed of giving liberty to the petitioner to file a comprehensive representation in respect of his claim by enclosing all the relevant documents to substantiate his claim including the copy of any previous representation made in that regard before the third respondent. If any such representation is filed before the third respondent along with certified copy of this order, the same shall be considered and decided in accordance with law preferably within a period of six weeks from the date of filing of such representation. If the claim of the petitioner is found to be in order, then necessary formalities shall be concluded and necessary order shall be passed without much delay so that retiral dues of the petitioner, if any payable, be paid to the petitioner.

It is made clear that this Court has not expressed any opinion on the merits of the claim of the petitioner. The aforesaid exercise shall be completed strictly in accordance with law after verifying the facts from the record and providing opportunity of hearing to the 4th and 5th respondents.
