Sri Sanjeev Kumar Gaur, and Ms. Babita Upadhyay, Advocates, have filed their Vakalatnama jointly today on behalf of respondent no. 3 - Smt. Saba Sherwani, which is taken on record.

Heard learned counsel for the parties and perused the record.

It is submitted by learned counsel for the respondent no. 3 that the WILL in dispute is dated 06.08.2008. She is not disputing originality of the WILL, but the applicant filed another WILL before the Tax Assessing Officer, whereby the Tax Assessing Officer observed that the WILL filed before him is different. It is submitted by learned counsel for the applicant that no forgery has been committed by the applicant and nowhere any manipulation has been made by the applicant, whereas as per order of the Tax Assessing Officer that has been shown by the respondent no. 3 it can very well be inferred that there seems to be some interpolation. It is ordered that on the basis of WILL on which this order has been passed, copy of that will be produced by respondent no. 3 on the next date of listing.

List again on 12th August, 2016, as fresh, in supplementary list.
