It is stated that previously in response to the communication of the High Court, the District Judge, Bareilly has sent the list of the surplus drivers wherein the petitioner's name did not figure.

It is further stated that the petitioner no.1 is driving the vehicle of the District Judge, Bareilly for the last 15 years and the petitioner no.2 is driving the official vehicle of the Chief Judicial Magistrate for more than five years.

It is also stated that some of the surplus drivers are working in the copying department and instead of sending the name of those drivers, the petitioners' name have been illegally sent in the newly created judgeship at Hapur.

Lastly, it is urged that the transfer cannot be a mode of appointment in a newly created judgeship.

Put up this case on 18.04.2016 as supplementary fresh.

Till then, the petitioners shall not be relieved from the district Bareilly.
