It is contended by the learned counsel for the petitioner that the petitioner is a dependent of freedom fighter. The respondent no.2 made an advertisement for appointment on Class IV post. Total 21 posts were advertised. It is stated that 2% post is to be filled up by the dependents of the freedom fighter. However, no appointment has been made under the quota of freedom fighter.
A counter affidavit has been filed. In paragraph no. 10 of the counter affidavit, it is averred that out of 21 posts, 17 posts are unreserved and as per reservation rules, 2% quota is provided for freedom fighter's dependents, accordingly, 2% horizontal of 17 posts comes to 0.34, therefore, no post reserved for freedom fighter. Reliance has been placed on a decision of this Hon'ble Court in the case of Dr. Vishwajeet Singh and other v. State of U.P. and others, 2009 A.W.C. 2929.
On the joint requests of the learned counsel for the parties, list this case again in the next cause list among top ten cases.
