Heard Sri Saif Ali, learned counsel for the applicants and Sri Manish Deo, learned A.G.A. appearing for the State, and perused the record.

This application under Section 482 Cr.P.C. has been filed by the applicants for quashing the proceeding of Section 82 Cr.P.C. dated 17.09.2015, issued by the Judicial Magistrate-III, Allahabad, in Case Crime No. 271 of 2014, under Sections 147, 436, 427, 506 IPC, Police Station Shankargarh, District Allahabad. He further prayed for stay the proceeding of the aforesaid case.

It has been pointed out by the learned AGA that matter against the applicants is still under investigation and no charge-sheet has been submitted against the applicants. 

Learned counsel for the applicants has admitted the fact that no charge-sheet has been submitted against the applicants and prays that present application be dismissed as not pressed with liberty to file the fresh 482 Cr.P.C. application at an appropriate stage.

The present 482 Cr.P.C. application is, accordingly, dismissed as not pressed with liberty to file the fresh 482 Cr.P.C. application at an appropriate stage.
