Heard Sri Rajesh Kumar Maddeshiya, learned counsel for the applicant, and Sri Nitin Srivastava, learned AGA appearing for the State and perused the record.
The only prayer made by the applicant is that a direction be issued to the court below to conclude the trial in short span of time as fixed by this Court, the Criminal Case No. 720 of 2008 (State Vs. Shoaib), arising out of Case Crime No. 434 of 2008, under Sections 420, 467, 468, 471 IPC, pending before the court of Judicial Magistrate, Mawana, District Meerut.
It is has been argued by the learned counsel for the applicant that applicant is an accused in the present case and the charges has been framed against him on 21.08.2010, and no prosecution witnesses have appearing before the trial court to give their evidence.
Considering the fact and circumstances of the case the trial court is directed to ensure the presence of the prosecution witnesses, in accordance with law, and conclude the aforesaid case in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible preferably within a period of six months from the date of production of certified copy of this order, if there is no legal impediment.
