Allahabad High Court
Dhirendra @ Babloo And 6 Others vs State Of U.P. And Another on 23 September, 2015
Bench: Ramesh Sinha

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 53

Case :- CRIMINAL REVISION No. - 2264 of 2015

Revisionist :- Dhirendra @ Babloo And 6 Others

Opposite Party :- State Of U.P. And Another

Counsel for Revisionist :- K.N. Mishra

Counsel for Opposite Party :- Govt.Advocate

Hon'ble Ramesh Sinha,J.

Case called out in the revised list. No one is present on behalf of the revisionists to press this revision. Learned A.G.A. for the State is present.

This revision has been preferred by the revisionist for quashing the impugned order dated 27.3.2015 passed by Additional Civil Judge (Junior Division) Court No. 13, Deoria in Case No. 3614 of 2013 (State Vs. Dhirendra alias Babloo) under Section 498-A I.P.C. and 3/4 D.P. Act, Police Station- Khukhundu District-Deoria on the discharge application of the revisionists by which rejected the discharge application dated 3.3.2012 as filed by the revisionists.

As per the report of the Mediation Centre dated 4.8.2015, the revisionists have not complied with the order of this Court dated 8.7.2015, whereby they were directed to deposit the amount of Rs.15,000/- in the Mediation Centre, hence, the Court proceed to examine the matter on merits.

Heard learned AGA for the State and perused the material available on record as well as the impugned order.

I have gone through the revision along with the affidavit filed in support of this revision as well as the impugned order passed by learned Magistrate and I find that the same does not suffer from any illegality, infirmity or jurisdictional error requiring any interference by this Court. The revision lacks merit and is liable to be dismissed. Hence, it is, accordingly, dismissed.

Interim order, if any, stands vacated.

The Registrar General  is directed to send a copy of the order to the trial court to proceed with the trial, if not concluded.

Order Date :- 23.9.2015

Ishan
