Heard learned counsel for the parties.

The case of the petitioner is that private respondents have encroached the earmarked area of land, which was being used by the general public in large as common path. In this regard the petitioner made a representation before the Sub-Divisional Magistrate, Meja, District Allahabad, but no action has been taken. Hence, this petition.

In the facts and circumstances of the case, it is desirable that the grievance of the petitioner may be examined at the first instance.

We accordingly dispose of the writ petition by requiring the petitioner to make a representation along with a certified copy of this order before respondent no.2-Sub-Divisional Magistrate, Meja, District Allahabad within two weeks from today. If such representation is filed, respondent no.2 shall take appropriate decision in accordance with law preferably within eight weeks thereafter. All consequential actions shall be taken accordingly.
