Hon'ble Arun Tandon,J.

Hon'ble Ashwani Kumar Mishra,J.

Heard learned counsel for the parties.

Petitioners seek writ of mandamus commanding respondents to decide their representation dated 7.8.2014.

The prayer appears to be innocuous but in fact, in his attempt to reopen a dead issue.

Petitioners claimed to have purchased Khasra No. 69 on 9.3.1987. It is stated that the said land has been acquired under notification dated 25.3.1991. Petitioner no.2 is stated to have filed Writ Petition No. 10473 of 1991, whereunder the dispossession was stayed, wherein the award in respect of the acquired land was made under Section 9 of the Land Acquisition Act,1894. On 29.3.1993, name of the petitioner mentioned therein. Petitioner noo.1 filed Writ Petition o. 10798 of 1991, where also an interim order restraining writ petition was granted. It is then stated that the authority is marked as disputed land duty of execution. It is stated that the name of the petitioners have mutated in revenue records on 30.9.1989. Petitioners claimed that compensation has not been taken. On these pleadings, the petitioners claim cancellation of their represenation.

The writ petition is completely silent as to what has happened to Writ Petition No. 10473 of 1991 and 10798 of 1991 filed by the present petitioners. This petition appears to be an attempt to overreach the outcome of the aforesaid writ petition.

In absence of completed facts being disclosed, no relief can be granted. The writ petition is, therefore, dismissed.

Order Date :- 15.9.2015
