Heard learned counsel for the petitioners and the learned A.G.A.
Petitioners seek quashing of the F.I.R. dated 4.8.2015 being Case Crime No. 76 of 2015, under Sections 498A, 323, 506, 307 I.P.C. and under Section 3/4 D.P.Act, Police Station Mahila Thana, District Bulandshahr.
It is stated on behalf of the petitioners that the accused-husband shall surrender and will apply for bail within two weeks from today. It is further submitted that the allegations made in the First Information Report are false and reflect a concocted story.
We have examined the First Information Report. It does disclose a cognizable offence. No case for quashing of the First Information Report is made out. The prayer in that regard is rejected.
However, in the facts of the case, we provide that the petitioners shall not be arrested in the above mentioned case, till submission of the police report.The husband does not seek bail as aforesaid.
With the aforesaid observations/direction, the present writ petition is finally disposed of.
