An Affidavit of compliance has been filed Sri Vaibhav Krishna-opposite party stating therein that in compliance of the order of the writ court, the petitioner has been reinstated in service vide order dated 27.8.2015.
Learned Counsel for the petitioner after seeing the affidavit of compliance, submitted that it is incorrect to say that there is an absolute compliance of the order rather it is a sham compliance as only the order of reinstatement has been passed but he has not been provided consequential service and pecuniary benefits including the amounts which he would be entitled to get upon the reinstatement in service under the relevant Rules.
At this stage, learned Standing Counsel submitted that he may be allowed some reasonable time to comply the order in its word and spirit.
In view of the above, two weeks' time is granted to the opposite party no.2 to make full compliance in its word and spirit failing which he shall appear on the next date fixed for framing of charges.
List this case on 28.9.2015.
