1. The petition seeks issuance of a writ in the nature of Certiorari quashing First Information Report dated 28-07-2015 bearing Case Crime No. 607 of 2015, under section 366  Indian Penal Code, Police Station-Thakurganj, District-Lucknow.

2. Counter Affidavit filed in court is taken on record.

3. In Counter Affidavit, it has been stated that statement of the victim has been recorded under section 164 Cr.P.C. The victim has not supported the prosecution case. She has admitted her marriage with Shailendra Maurya.

4. The Investigating Agency has concluded that offence has not been committed. Consequently, final report has been forwarded for filing.

5. Considering the above, it is evident that cause of action does not survive.

6. Accordingly, the writ petition is disposed of as infructuous.

7. In case final report has not been filed till date, let needful be done within three weeks.
