Heard learned counsel for the parties and perused the record.

The petitioner before this Court seeks quashing of the demand notice dated 16.9.2015. Both on merits as well as on the ground that demand has been raised without notice of hearing to the petitioner.

Sri Satish Mandhhyan, counsel for the Krishi Utpadan Mandi Samiti, Moradabad submits that the order is only a notice to the petitioner to pay the money and in case, he files any reply denying his liability, the matter shall be examined and final order shall be made only thereafter.

We accordingly dispose of the writ petition with a direction to the petitioner- M/S Satya Chandra Flour Mill Pvt. Ltd. to file a reply to the letter dated 16.9.2015 treating it to be a show cause notice within two weeks from today along with a certified copy of this order. The respondents shall examine the grievance of the petitioner and decide the same by means of a reasoned order strictly within two weeks in accordance with law.

All consequential action action shall be taken accordingly.
