Heard learned counsel for the parties.

The petitioner is aggrieved by transfer and posting from Shahgarh to Shuklabazar District Amethi. The ground of transfer is that earlier report that he has completed five years service in a back-ward area which is the basis for transfer to Shahgarh was baseless as the fact is that the petitioner has not completed five years service in a back-ward area.

The petitioner disputes the factual basis for the impugned action.

In these circumstances, the writ petition is disposed of with liberty to the petitioner to file a representation to the District Basic Education Officer, Amethi raising his grievance within a period of one week. In such an eventuality, the District Basic Education Officer, Amethi, shall look into the matter in accordance with the rules and policy decisions of the State Government applicable and shall take a decision afresh within a period of next three weeks.

Till the decision is taken by the authority concerned the status-quo as regards the posting and working of the petitioner shall be maintained.

With the aforesaid observations, the writ petition is disposed of.
