Heard learned counsel for the petitioners and the learned A.G.A.
Petitioners seek quashing of the F.I.R. dated 22.9.2015 being Case Crime No.35 of 2015, under Sections 323, 504, 506, 498A I.P.C. and under Section 3/4 D.P. Act, Police Station Mahila Thana, District Kaushambi.
It is stated on behalf of the petitioners that the accused-husband shall surrender and will apply for bail. The appellants who are family members have falsely been roped in..
We have examined the First Information Report. It does disclose a cognizable offence. No case for quashing of the First Information Report is made out. The prayer in that regard is rejected.
However, in the facts of the case, we provide that the petitioners shall not be arrested in the above mentioned case, till submission of police report.
With the aforesaid observations/direction, the present writ petition is finally disposed of.
