2015 Latest Caselaw 4373 ALL

Citation : 2015 Latest Caselaw 4373 ALL
Judgement Date : 20 November, 2015

Allahabad High Court
Hari Om Alias Guddu vs State Of U.P. on 20 November, 2015
Bench: Manoj Misra

HIGH COURT OF JUDICATURE AT ALLAHABAD

?Court No. - 54

Case :- CRIMINAL MISC. BAIL APPLICATION No. - 41364 of 2015

Applicant :- Hari Om Alias Guddu

Opposite Party :- State Of U.P.

Counsel for Applicant :- Rakesh Pati Tiwari

Counsel for Opposite Party :- G.A.

Hon'ble Manoj Misra,J.

Heard learned counsel for the applicant, the learned A.G.A. for the State and perused the record.

The present bail application has been filed by the applicant in case crime No. 751 of 2013, under Sections 498A, 304B I.P.C. and 3/4 D.P. Act, police station Puranpur, District-Pilibhit with the prayer to enlarge him on bail.

At the outset, learned counsel for the applicant has stated that the trial is proceeding and three witnesses have so far been recorded, who have not supported the prosecution case.

Learned AGA has submitted that the applicant is the husband of the deceased and the postmortem report of the deceased reveals several ante-mortem injuries and since the deceased has died as a result of strangulation and smothering and she has died within seven years of her marriage, it would not be appropriate for this Court to express any opinion for grant of bail to the applicant.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Court does not find it to be a fit case for grant of bail to the applicant at this stage.

The bail application of the applicant stands rejected with a direction to the trial court to conclude the trial expeditiously, preferably, within a period of six months from the date of production of certified copy of this order.

Order Date :- 20.11.2015
