The petitioner has challenged the promotion of the opposite party no.5 on the Class III post at Lal Bahadur Shastri Maha Vidyalaya, Gonda on the ground that as per the Government Order dated 28.5.1984, 15 per cent reservation has been provided for filling up Class III post from Class IV employees, who were completed 5 years of continuous service and posses requisite qualification, but ignoring the qualification of the petitioner much junior person (opposite party no.5) has been promoted by giving the benefit of Scheduled Caste category. Further submission of the learned Counsel for the petitioner is that after the judgment of Hon'ble Apex Court in the case of U.P.Power Corporation Ltd. Vs. Rajesh Kumar and others reported in 2012 (30) LCD 897, the persons who were given benefit of promotion between 1997 to 2012 were required to be reverted and the State Government in pursuance to the said judgement has issued Government Order on 21.8.2015, but till date no action has been taken in compliance of the same.

Learned Standing Counsel is directed to seek instructions as to what action has been taken in compliance of the Government Order dated 21.8.2015 in the matter.
