Heard Sri Rajesh Kumar, learned counsel for the applicants and learned A.G.A.

The present application under Section 482 Cr.P.C. has been filed for quashing the Charge-sheet dated 30.5.2013 and non-bailable warrant dated 22.8.2015 & 22.9.2015 passed by Judicial Magistrate, Mau and the entire proceedings of Case No. 554 of 2013 ( State Vs. Mohammad Tahir and others), under Sections 498A and 323 IPC and Section 3/4 D.P. Act, Police Station Dakshin Tola, District Mau.

It is a matrimonial matter. Learned counsel for the applicants state that the applicants are prepared for settlement by way of mediation. The matter is referred to Mediation and Conciliation Centre of this Court. The applicants shall deposit a sum of Rs.15,000/- by way of demand draft/ pay order payable at Mau in the name of opposite party no. 2 within a period of three weeks from today before the Mediation and Conciliation Centre, Allahabad. The said amount shall be handed over to opposite party no. 2 on the date fixed before the Centre.

Issue notice to opposite party no. 2.

O.P. No. 2 may file counter affidavit within a month. Rejoinder, if any, may be filed within two weeks thereafter.

List on 2nd February, 2016.

Till the next date of listing, further proceedings of Charge-sheet dated 30.5.2013 and non-bailable warrant dated 22.8.2015 & 22.9.2015 and the entire proceedings of Case No. 554 of 2013 ( State Vs. Mohammad Tahir and others), under Sections 498A, 323 IPC and Section 3/4 D.P. Act, Police Station Dakshin Tola, District Mau, pending in the Court of Judicial Magistrate, Mau, shall remain stayed.

The office shall issue certified copy of this order, only upon furnishing the proof of the said deposit.
