HIGH COURT OF JUDICATURE AT ALLAHABAD, LUCKNOW BENCH ?Court No. - 4 Case :- SPECIAL APPEAL DEFECTIVE No. - 541 of 2015 Appellant :- Hena Tabassum 422(M/S)2014 Respondent :- State Of U.P.Thru Secy.Deptt.Of Basic Edu.Lko.And Ors. Counsel for Appellant :- Maneesh Kumar Singh,Navita Sharma Counsel for Respondent :- C.S.C.,Manish Mishra Hon'ble Amreshwar Pratap Sahi,J.
Hon'ble Attau Rahman Masoodi,J.
Heard learned counsel for the appellant.
The delay of 12 days has been sufficiently explained in the affidavit filed in support of the application for condonation of delay.
We accordingly condone the delay and treat the appeal to be within time.
The contention of the petitioner is that she was allegedly informed that she had not filled up the challan number of the deposit which was tendered. The same was taken to be a violation of Clause 5 of the government order dated 17.8.2013 and accordingly her application form appears to have not been entertained, otherwise the petitioner was entitled for counselling as an Urdu teacher keeping in view her merit.
Let the respondents produce the relevant records on the next date of listing, relating to the e-application of the petitioner coupled with the documents filed alongwith the application as also the hard copy which was sent later on.
List on 20.11.2015.
