Having heard the learned counsel for the petitioner and having perused the material placed on record, we are not persuaded to entertain this matter as a Public Interest Litigation where the petitioner seeks to allege certain so-called encroachments by the private individuals i.e., the respondents no. 5 to 8.
The suggestions, as made by the petitioner about the encroachment by the private individuals in this writ petition directly entail inquiry into various questions of fact and there does not appear any reason to entertain this matter as Public Interest Litigation for determination of such questions of fact. Moreover, it appears that the complaints made by the petitioner have acquired attention of the authorities concerned and reports have been taken thereupon.
The petitioner is otherwise free to take recourse to the appropriate proceedings in accordance with law.
With the observations foregoing, the petition stands dismissed.
