Heard Sri Virendra Kumar Shukla, learned counsel for the applicants, learned A.G.A. for the State and perused the record.
The applicants are seeking quashing of the proceedings of Complaint Case No. 2908 of 2014, Girish Dutt Shukla Vs. Ram Bharat and others, under Section 379, 427, 504, 506 I.P.c., Police Station Badlapur, District Jaunpur, pending in the Court of Additional Chief Judicial Magistrate, Court No.14, Jaunpur.
The allegation made in the complaint by opposite party no.2 is that the applicants in the night of 2.3.2014 at about 10:30 P.M. came to his field and started cutting the standing crop of Sarso (mustard) and tying in bundles. There is also a civil dispute pending before the Assistant Consolidation Officer in respect of the plot in question.
Considering these facts, I am of the opinion that the matter requires consideration.
Issue notice to opposite party no.2 returnable within four weeks. Steps to serve the notice be taken within three days.
Counter affidavit may be filed within four weeks.
List thereafter.
Till the next date of listing, the operation of proceedings in Complaint Case No. 2908 of 2014, Girish Dutt Shukla Vs. Ram Bharat and others, under Section 379, 427, 504, 506 I.P.c., Police Station Badlapur, District Jaunpur shall remain stayed.
