Heard Sri Rahul Pandey, learned counsel for the applicant.

The applicant is seeking a direction to the court below to expeditiously decide the Complaint Case No. 3601 of 2011, Kiran Dutt Vs. Amit Jain and others, under Sections 147, 323, 325, 506 I.P.C., P.S. Vijay Nagar, District Ghaziabad.

The contention is that proceedings have not moved after 30.5.2013 and on each date, applicant is present but the case is being adjourned on account of the accused persons but the accused persons are not appearing in the case. This case is at the stage of evidence of the prosecution.

In this view of the matter, this application is allowed and a direction is issued to the court below to expeditiously decide the Complaint Case No. 3601 of 2011, Kiran Dutt Vs. Amit Jain and others, under Sections 147, 323, 325, 506 I.P.C., P.S. Vijay Nagar, District Ghaziabad expeditiously prefereably within a period of six months from the date of receipt of certified copy of this order.
